Equity Residential Accused of Improper Deductions from Security Deposits

Equity Residential Properties (EQR) is the largest owner/operator of residential apartment complexes in the country and one of the largest in California. In an action filed in Santa Clara County, California, Equity Residential is accused of making improper deductions from tenants' security deposits, including: deductions for the cost of ordinary wear and tear on the carpets, deductions for the cumulative effect of prior tenants wear and tear on paint, and deductions for cleaning beyond ordinary wear and tear. Equity Residential is also accused of failing to document the condition of apartments upon move-in and move-out and failing to timely return security deposit refunds.
