HP Pavilion Settlement


On October 31, 2007, U.S. District Court Judge Ronald M. Whyte, Northern District of California, entered an order preliminarily approving a settlement of the class action lawsuit brought by owners of certain models of Hewlett-Packard ("HP") Pavilion notebook computers. Notebook owners are entitled to submit claims for repairs, cash reimbursement for out-of-pocket repair expenses, and/or discount coupons, each described in more detail in the Notice found at www.hpnotebooksettlement.com The Notice and a Claim Form was emailed to class members and will be published in both USA Today and U.S. News and World Report.

The www.hpnotebooksettlement.com website is the most comprehensive resource for information about the settlement. In addition to providing a copy of the Notice describing the lawsuit, your rights to obligations as a class member, and how and when to submit a claim, you will also find answers to many commonly asked questions, a copy of the Settlement Agreement, copies of the complaints that precipitated the settlement, and a description of how to locate the model, SKU and serial number of your notebook to determine whether your notebook is included in the settlement.

You will note that the Claim Form is not included on this website or on the www.hpnotebooksettlement.com website. This was by agreement with HP. If you did not receive a Claim Form via email along with the Notice, the only way you can obtain one is from the Settlement Administrator by either calling 1-800-657-1876 or writing to Power Plug & Graphics Card Litigation Settlement Administrator, P.O. Box 1898, Faribault, MN 55021-7153. Be sure to include your name and mailing address. We cannot provide a Claim Form directly to you.

If you have one of the notebooks listed in the Notice, you may be eligible for relief under the settlement. Please read the Notice and Claim Form carefully to determine (a) whether you are entitled to one or more of the forms of relief, and (b) what information you must submit to the Settlement Administrator to make your claim. Please note that your Claim Form and all requested information must be postmarked by no later than February 8, 2008, or it will not be considered. All Claim Forms must be sent to the Settlement Administrator, not to us, at the address indicated in section 11 of the Notice.

Once the Settlement Administrator receives your Claim Form they will send you a letter stating whether your claim has been approved or denied. If your claim is approved, the letter will provide instructions as to what you should do next. For example, if your claim is for a repair, the letter will state that you will receive a postage paid box which you can use to ship your computer to a designated location at no cost to you.

If you have a notebook that is not listed in the Notice, then the Settlement Agreement does not apply to you. Accordingly, the Settlement does not bind you or release any rights you may have to bring a claim against HP within the appropriate statute of limitations. In that event, we do not represent you through this settlement, and you should take whatever steps you deem necessary to preserve any claims you may have.
